Community property and debts are to be equally divided in California. Separate property remains the property of the party acquiring it. With these general rules in California come several important exceptions. Therefore, all property acquired during the marriage must first be identified and "characterized" as community or separate so that it can then be equally divided. Such issues as reimbursements for payment of community debts, use of community assets, etc. must be accurately analyzed so that "an equal division" can be accomplished. I have handled thousands of such divisions in a manner calculated to obtain fair and equitable results. Who gets the home? Must it be sold? How is money owed by one spouse to the other secured? Can this order be enforced? All these issues and others will be addressed.
